These Terms & Conditions (“Terms”) govern your use of aviyanka.com (the “Site”) and any purchase made through it, operated by Exorti Inc., DBA Aviyanka by Exorti, Resonance by Exorti, and Kate Dillingham by Exorti (“Exorti,” “we,” “us,” or “our”).

By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.


1. Who We Are

2. Products and Availability

All products are subject to availability. We reserve the right to limit the quantity of any product, discontinue any product, or correct errors in pricing or product descriptions at any time without prior notice, even after an order has been submitted.

Limited edition collections, including the Resonance Collection, are produced in finite batches. Once a batch sells out, that specific batch will not be restocked, though future batches or editions may be released at our discretion.


3. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to change prices at any time without notice, though changes will not affect orders already placed and confirmed.

We use Stripe and PayPal to process payments. By placing an order, you authorize us to charge your selected payment method for the full order amount, including applicable taxes and shipping.

For certain orders, your payment method may be authorized at the time of order and charged once your item ships. We will communicate the relevant payment timing for your specific order at checkout or in your order confirmation.


4. Custom and Made-to-Order Items (Including Resonance Collection)

Items described as custom, made-to-order, or part of a limited edition collection (including the Resonance Collection) are produced specifically for you and are subject to the following terms:

  • You may cancel a custom or made-to-order item for a full refund within 2–5 business days of placing your order, provided production has not yet begun.
  • Once production has begun, the order is final and cannot be cancelled, returned, or refunded, except in the case of a manufacturing defect (see Section 6).
  • We will make reasonable efforts to notify you of estimated production timelines, but timelines are estimates and not guaranteed.

5. Returns and Exchanges — General Merchandise

For all products other than custom, made-to-order, or limited edition items described in Section 4:

  • Returns are accepted within 30 days of delivery for a full refund.
  • The item must be returned in its original, unworn condition, with all original tags, packaging, and certificates of authenticity intact.
  • Return shipping and insurance costs are the responsibility of the customer. We recommend using a trackable, insured shipping method, as we are not responsible for items lost or damaged in return transit.
  • Refunds will be issued to the original payment method once the returned item has been received and inspected.
  • Items that show signs of wear, alteration, or damage not present at the time of delivery will not be eligible for a refund and may be returned to the customer at their expense.

6. Lifetime Warranty — Fine Jewelry

Our fine jewelry pieces are covered by a lifetime warranty against manufacturing defects, subject to the following conditions:

  • Coverage includes manufacturing defects such as faulty settings or structural issues arising from craftsmanship.
  • General wear and tear is not covered, including but not limited to scratching, tarnishing, bent prongs from impact, or loss of stones due to wear over time.
  • Where repair or replacement is warranted, we will repair or replace the item depending on the availability of matching materials and components at our discretion.
  • One-of-a-kind items cannot be replaced if the original materials are no longer available. In such cases, we will offer a refund instead of a replacement.
  • This warranty does not cover items purchased through unauthorized third-party resellers, nor does it cover loss, theft, or damage resulting from accident, misuse, or unauthorized repair by a third party.

7. The Resonance Collection Music Portal

Pieces from the Resonance Collection include access to a QR card connecting to a third-party platform, MyBlueSkies Music (https://myblueskiesmusic.com/), offering a free trial period followed by an optional paid subscription.

  • The free trial period and any subsequent subscription are governed by MyBlueSkies Music’s own terms of service, separate from these Terms.
  • Exorti Inc. is not responsible for the availability, content, billing, or technical performance of the MyBlueSkies Music platform.
  • Activating the music portal feature requires sharing certain account information with MyBlueSkies Music, as described in our Privacy Policy.

8. Shipping

We primarily ship to customers within the United States but accept orders from other countries with no restrictions. Shipping timelines provided at checkout are estimates only and are not guaranteed.

International customers are responsible for any customs duties, import taxes, or fees imposed by their country upon delivery. We are not responsible for delays caused by customs processing.

Risk of loss and title for items purchased passes to you upon our delivery to the shipping carrier.


9. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, images, product designs, and the Exorti, Aviyanka, and Resonance brand names, is the property of Exorti Inc. or its licensors and is protected by applicable copyright and trademark laws.

Music and audio content made available through the MyBlueSkies Music portal remains the intellectual property of Kate Dillingham and/or MyBlueSkies Music and is licensed, not sold, to you for personal use.

You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written permission.


10. Limitation of Liability

To the fullest extent permitted by law, Exorti Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any product purchased through it, including but not limited to loss of data, loss of profits, or damages resulting from third-party services such as payment processors or the MyBlueSkies Music platform.

Our total liability for any claim arising from your purchase shall not exceed the amount you paid for the relevant product.


11. Disclaimer of Warranties

Except as expressly stated in Section 6, all products are provided “as is” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

Any descriptions of crystal properties, healing qualities, or energetic effects associated with our products are provided for informational and traditional/cultural context only and do not constitute medical, psychological, or therapeutic claims.


12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York.


13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
